The Community Trademark (CTm) System

Modiano is among the first 10 European firms filing with the OHIM (Community Trademark Office in Alicante, Spain) and has developed a considerable experience, with its rate of more than 500 filings per year.

Over 35 members of Modiano are registered European Trademark Attorneys at the O.H.I.M.. Many of them have participated with their specific presentations at several Seminars and Conferences held on the Community Trademarks System, and have also published specialized articles on the subject; this shows the great care and attention paid to this new European Union Regulation.

Moreover, Modiano's office in Alicante can help in urgent and important matters which involve interviews with the Examiners and a direct personal contact with the Community Office.

Prosecution and Opposition

The knowledge of many European languages and laws has led Modiano to become a leading firm in prosecution and opposition matters in the Community Trademark System.

Our multilingual approach is extremely valuable in the preparation of the Community filing, where each proposed word mark is checked by our attorneys in the eleven languages spoken in the European Union for a prima facie check of the risk of descriptiveness: if such a risk appears, it is reported to the Applicant before filing, thus diminishing the probability of Official Actions by the Examiners. During the past years, our Opposition Department has acquired high-level expertise in both the filing of active oppositions in order to avoid registrations of potentially dangerous trademarks, and in the handling of passive oppositions in order to defend the rights of our clients over the whole European territory.
