欧盟普通法院就摩托车外观设计一案做出判决.

2019年9月24日,欧盟普通法院(GCEU)就意大利比亚乔集团(Piaggio & C. S.p.A.)与浙江中能工业集团关于摩托车外观的专有权诉讼作出了重要裁决。这项决定为摩托车等竞争激烈的行业中解决平衡专有权与自由市场的平衡问题确立了方向。 比亚乔集团基于其Vespa LX 款式外观(如图1)的在先外观设计权、立体商标权和版权,对中能工业的一件欧盟外观设计(下称“中能设计”,如图2)的有效性提出质疑。 (图1) (图2) 欧盟普通法院的判决驳回了比亚乔集团的要求。法院认为,中能设计符合必要的有效性要求,且不侵犯比亚乔集团的任何在先权利。 判决还指出,中能设计与Vespa LX的外观设计相比没有实质性相似,因而具有新颖性。同时,基于用户能够对两种设计产生不同的整体印象,中能设计亦具有独特性。法院对中能设计是否会让了解Vespa LX的知悉用户产生似曾相识感进行了调查,并得出结论认为,中能设计基本上以直线型为主,而Vespa LX主要以流线型设计为主,因此相关知悉用户对两个设计的整体印象事实上完全相反。 根据该判决,中能设计也没有侵犯比亚乔集团Vespa LX外观的未注册商标权。法院认为,一般消费者不会注意到比亚乔集团声称具有独特性的四个特征(后端外壳与后座之间的 X 形设计、后座和腿护罩之间的倒Ω形状、箭头形状的前挡板、泪滴形状的外形)。相反,一般消费者会整体观察比亚乔摩托车的风格、线条和整体外观,而以上元素与中能设计有明显的不同。 比亚乔集团为Vespa摩托车外形以上四个特征申请了版权,这四个特征体现了1946年款Vespa摩托车艺术和创作核心:圆润、女性化、复古。中能设计并不具有这四项特征,也不具有圆润、女性化和复古性的特点。相反,中能设计以直线和直角为主。因此,Vespa外观和中能设计带来的整体印象是不同的。 欧盟普通法院这一决定意义重大,它划定了摩托车行业外观设计的保护范围与立体商标或版权之间的界限,一方面确认了立体商标权和版权的价值,另一方面确认了竞争对手使用不同产品进入市场的限制。 […]
