On July 8, 2011, the decree on the oppositions to Italian trademarks and International trademarks designating Italy has finally been published in the Italian Official Gazette.

Thus, it will at last be possible to file an administrative trademark opposition in Italy as well.

In particular, the deadline for filing a trademark opposition will be as follows (Art. 176 of the Italian IP Code):

– 3 months from the publication of the application, for all Italian applications filed on or after May 1st and published in the Italian Bulletin on or after July 2011.

– 3 months from the publication of the registration, for all Italian registrations filed on or after May 1st and whose registration is published in the Italian Bulletin on or after July 2011.

– the 1st day of the month subsequent to the month of publication in the OMPI Gazette, starting July 2011, for all International trademarks designating Italy.

Art. 187 of the Italian IP Code provides that the Italian Bulletin will be published once a month, starting in July 2011.

Thus, provided that the Italian Bulletin will be in fact published this month, it will be possible to file the first oppositions against Italian trademark applications and registrations in October 2011. As for the Italian portion of International registrations, the opposition option will be available starting November 1st, 2011.
