Carlo Comolli Acquaviva

Attorney-at-law
Carlo has a wide-ranging and consolidated experience in the protection of intellectual property rights (trademarks, models, patents, copyright, know-how, and domain names), which he draws on to assist national and international clients in the IP right's strategic, formative and constitutive phases, in facilitating the economic exploitation and management of the right, and in protecting it against third parties.

He mainly offers legal assistance out of court (consultancy, contracts, due diligence, and disputes) and in court, including administrative (opposition procedures), civil (precautionary actions and actions on the merits, for infringement, patent interference, unfair competition and invalidity of intellectual property rights) and criminal (counterfeiting and receiving stolen goods).

Carlo also handles problems with customs surveillance at international level (intervention requests, suspension of release of products, appraisals and subsequent steps) and, more generally, activities related to the enforcement of intellectual property rights. 

At the contractual level, he drafts licensing contracts, distribution contracts, and contracts for R&D cooperation in new technologies, coexistence contracts, assignment contracts and contracts for joint ownership of intellectual property rights.

Carlo works with multinationals, listed companies, and small and medium enterprise in the sectors of fashion, furniture and luxury goods, automotive, sports, pharmaceuticals, communications, publishing, and food, and he advises innovative startups, drawing on links with universities and research institutions in Italy and abroad. 

Carlo graduated from university with a thesis on private law titled "Grounds for invalidity in matrimony". 

Prior to joining Modiano & Partners, Carlo gained experience in his family's law firm, which was founded in 1969 and works in family law (separation, divorce and succession), and he also fulfilled an internship at a prestigious law firm in London.
