Trademark attorney
Erica is a member of our foreign trademark opposition department. 

She assists clients in filing and in managing oppositions, invalidation actions and non-use cancellation actions before national, European and international Trademark Offices and before courts worldwide, staying at the client's side at every stage and level of authority of the proceeding. 

In cooperation with foreign associates, she analyzes each case, choosing the best strategy to achieve the client's objectives.

She has consolidated experience in drafting detailed briefs in fact and in law, including based on analytical jurisprudential research.

In proceedings before the European Union Intellectual Property Office, Erica handles the study and filing of requests to limit products and services and to withdraw trademark applications.

Her practice includes the preparation and sending of cease-and-desist letters to adverse parties, out-of-court matters including negotiations between parties, the drafting of settlement agreements, coexistence agreements and affidavits, due diligence, legal opinions on the chances of success of an aggressive action against third parties and, in general, on the confusability of trademarks, as well as assisting clients with releasing letters of consent.

Erica also has experience in the analysis, classification and organization of the necessary documents to demonstrate the renown of the client's trademark and in drafting affidavits to support this argument. In this area, she also coordinates the consular legalization or legalization with apostille of documents, and ensures fulfillment of any formalities required by foreign jurisdictions.

She assists local and international clients in many sectors including fashion, automotive, sport, food and drink, winemaking, manufacturing, industrial products, pharmaceutical products, furnishing, consumer goods, home automation, and more. She works with large multinational corporations, small and medium enterprises, private individuals, venture capital companies and angel investors, both national and foreign, including non-owners of trademarks.

Erica graduated from university with a thesis in industrial law titled “Trademark validation”.

Prior to joining Modiano & Partners, Erica gained experience in the legal office of a prestigious international holding company.
