Francesca is a member of our foreign trademark opposition department.
In her work she evaluates clients' trademark portfolios and identifies the best attack or defense strategy to protect their trademarks.
She has consolidated experience in handling oppositions, invalidation actions and non-use expiration actions before the European Union Intellectual Property Office and foreign Trademark Offices worldwide, at all instances of appeal, working closely with foreign associates.
She has also gained significant experience in drafting and assessing affidavits, in assisting clients in sourcing documents to prove the use and renown of their trademarks, and in obtaining notarial certification and legalization of documents.
In out-of-court matters, Francesca's work ranges from drafting and assessing cease-and-desist letters to handling negotiations aimed at resolving disputes amicably; and her work can result in the drafting of coexistence agreements, unilateral declarations, and trademark limitation or withdrawal requests.
She also assists clients in releasing letters of consent to the registration and use of third-party trademarks applied for after the clients' trademarks and similar to them.
Francesca works with national and foreign clients operating in a variety of sectors, including clothing, footwear, automotive, mechanical engineering, pharmaceuticals and food. She works with multinational corporations, small and medium enterprises, sole traders and physical persons.
Francesca obtained her degree in criminology with a thesis titled “Family homicides".
Prior to joining Modiano & Partners, Francesca completed her law apprenticeship in debt recovery, bankruptcy law, and employment law.
