He has consolidated experience in procedures to defend trademarks filed abroad, having dealt with a vast range of objections from the Trademark Offices of different nations.
He assists clients in examining provisional refusals, in identifying defensive arguments and in drafting briefs of reply, in cooperation with foreign associates and based on local laws.
In addition, he assesses the further solutions available, both in a scenario of negotiating with adverse parties that own prior rights, and also in a more aggressive scenario against impediment trademarks, also examining the possibility of a prudential re-filing of the trademarks to be defended.
Simone has great expertise in dealing with administrative oppositions and cancellation actions brought by third parties. By assessing the strength of the parties' arguments and the sufficiency of the documents available, Simone defines the most appropriate defensive strategies, which can range from legal objections to the adverse party's arguments to amicable settlements to the proceedings.
He has handled a large number of appeals and petitions at successive instances of judgment, in which he has drawn on the assistance of foreign counsel to conduct defensive proceedings before their local courts, while Simone himself took up an essential role of liaison between the client and the instructed counsel.
Simone assists national and foreign clients that operate in different industrial, commercial and service sectors, including fashion, mechanics, transport, nutrition, consumer goods and construction. He works with clients ranging from small and medium enterprises to large multinational corporations with widely-varying commercial needs, i.e. manufacturing, distribution, import-export, franchising or merchandising.
Simone graduated from university with a thesis titled "Questions regarding the functions and efficacy of the law".
