Federica handles general consultancy and disputes relating to trademarks, models, copyright, comparative advertising and unfair competition.
With particular reference to trademarks, she assists national and foreign clients with administrative opposition procedures (both active and passive) against national trademark applications; she drafts rules for use for collective trademarks; she replies to Office objections from administrations against trademark application filings.
For designs and models, she handles invalidity actions (active and passive) before the European Union Intellectual Property Office.
She also handles contracts and negotiation and drafting of agreements, including licensing and sale agreements of national and foreign trademarks, coexistence agreements between trademarks at national and worldwide level, franchising contracts, sale agreements of pecuniary rights on intellectual works, non-disclosure agreements, and agreements with distributors.
Her practice also includes the negotiation and drafting of letters of consent to the registration of trademarks following refusals from various Offices, and the negotiation and drafting of agreements to cede and retrocede trademarks in order to overcome refusals in countries where Trademark Offices do not admit letters of consent.
She works with clients in the fashion, automotive, agrifood and pharmaceutical sectors.
Federica graduated from university in industrial law with a thesis titled “The trademark of stylists. The problem of deceitfulness”.
Prior to joining Modiano & Partners, Federica worked in the intellectual property and IT department of a major international law firm and for a boutique law firm specializing in intellectual property.
